By accessing our website, purchasing our courses, enrolling in our programmes, or using any of our educational materials (collectively, the “Services”), you (“the User,” “the Student”) agree to be bound by these Terms and Conditions (“Terms”).

Please read these Terms carefully before accessing our content. If you do not agree with any part of these Terms, you must strictly refrain from using our website and Services.

These Terms constitute a legally binding agreement between you and Nibal Trading Academy regarding your use of our platform and educational content.

By using our Services, you represent and warrant that:

Nibal Trading Academy is strictly an educational platform.

  • No Financial Advice: The content provided in our courses, live sessions, mentorship programmes, website, and communication channels is for informational and educational purposes only. It does not constitute financial, investment, tax, or legal advice.
  • No Fiduciary Relationship: No opinions, news, research, analyses, prices, or other information contained on this website constitutes a solicitation, recommendation, endorsement, or offer to buy or sell any financial instruments.
  • Independent Decision Making: You acknowledge that any trading decisions you make are solely your responsibility. We are educators, not financial advisors. You should always seek advice from a qualified and licensed financial advisor before making any investment decisions.

4. Risk Disclosure

Trading in financial markets (including but not limited to Forex, Stocks, Indices, Crypto, and Commodities) involves a high level of risk and may not be suitable for all investors.

  • Risk of Loss: You acknowledge that there is a possibility that you may sustain a loss of some or all of your initial investment. You should not invest money that you cannot afford to lose.
  • Market Volatility: Markets are unpredictable. Past performance of any trading system or methodology is not necessarily indicative of future results.
  • Leverage: The use of leverage can work against you as well as for you. It can lead to large losses as well as gains.

By using our Services, you agree that Nibal Trading Academy is not liable for any trading losses or financial damages you may incur.

5. No Guarantee of Results or Profits

We provide the tools, strategies, and psychological frameworks to help you understand the markets, but we do not guarantee profits or success.

We may share your data with trusted third-party service providers who assist us in operating our website, conducting our business, or serving our users, so long as those parties agree to keep this information confidential. These include:

  • Trading results vary significantly from person to person depending on individual capacity, dedication, background, and level of motivation.
  • We make no representation that any account will or is likely to achieve profits or losses similar to those discussed in our case studies or examples.
  • Any examples of success shown on our website are exceptional results and do not imply that the average student will achieve the same.

6. Intellectual Property Rights

All content provided by Nibal Trading Academy is the exclusive property of the Academy and is protected by international copyright and intellectual property laws.

  • Licence to Use: Upon purchase, we grant you a limited, non-exclusive, non-transferable, and revocable licence to access the course materials for your personal, non-commercial use.
  • Restrictions: You may not:
    • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service.
    • Share your login credentials with others.
    • Distribute, publish, or display our course materials (videos, PDFs, charts, text) publicly or privately to third parties.
  • Violation: Any unauthorised use of our content will result in the immediate termination of your account without refund and may lead to legal action seeking damages.

7. User Conduct and Account Security

  • Account Security: You are responsible for maintaining the confidentiality of your account login information. You agree to notify us immediately of any unauthorised use of your account.
  • Restrictions: You may not:
    • Harass, abuse, or harm another person or group (including staff and other students).
    • Upload or transmit viruses or malicious code.
    • Spam or solicit other users for commercial purposes.
    • Attempt to reverse engineer or hack any aspect of the platform.

8. Third-Party Links and Tools

Our Services may contain links to third-party websites, brokerages, charting software, or tools that are not owned or controlled by Nibal Trading Academy.

  • We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.
  • The inclusion of any link or reference to a broker or tool does not imply endorsement by us.
  • You acknowledge that you access these third-party services at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law:
  • Restrictions: You may not:
    • Your access to or use of (or inability to access or use) the Services;
    • Any conduct or content of any third party on the Service;
    • Any content obtained from the Service; and
    • Unauthorised access, use, or alteration of your transmissions or content.
In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid to us in the last six (6) months (if any).

10. Indemnification

You agree to defend, indemnify, and hold harmless Nibal Trading Academy and its employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising from:

  • Your use of and access to the Service;
  • Your violation of any term of these Terms;
  • Your violation of any third-party right, including without limitation any copyright or privacy right.

11. Indemnification

We reserve the right to terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If your account is terminated due to a violation of these Terms (e.g., sharing account access or piracy), you will not be entitled to any refund.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the competent courts located in the European Union.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
